AGREEMENT FOR BROKERAGE
 

THIS AGREEMENT made and executed at [Place] this [Date], by and between Shri___son of___, Indian Inhabitant, residing at [address](hereinafter referred to as the "OWNER", which expression shall, unless it be repugnant to the context or meaning thereof, be deemed to mean and include its successors and assigns) of the ONE PART AND Shri___son of___, Indian Inhabitant, residing at___(hereinafter referred to as the "REAL ESTATE BROKER", which expression shall, unless it be repugnant to the context or meaning thereof, be deemed to mean and include its successors and assigns) of the OTHER PART.

WHEREAS the Owner is the sole and lawful owner, lessee, allottee and in possession of flat / Property No.and the flat / Property consists of (Give the details of accommodation).                    

AND WHEREAS the aforesaid flat / property is self-acquired property / flat of the first party wherein his / her predecessors, heirs, successors, family members or any other person whosoever have no right, title or interest and as such the Owner is fully competent and has full and unfettered power to transfer / sell / lease / mortgage the said property / flat.

AND WHEREAS the Owner has agreed to register/ lists the said property more particularly described in the schedule hereinunder, with the Real Estate Broker for a period of _____days, from date hereof.

NOW THIS AGREEMENT WITNESSETH AS UNDER :

1. Owner lists the scheduled property with the Real Estate Broker for a period of _____days, from date of this agreement.
 
2. The Owner agrees to pay the Real Estate Broker a commission of _____% of the sale price should the Broker find a purchaser ready, willing, and able to pay at least Rs___________ for the property or such other sum as may be accepted by Owner. Said commissions are payable upon closing.
 
3. The Owner retains the right to sell the property directly on his or her own behalf with no sales commission to the Real Estate Broker, so long as the Broker did not find this purchaser. The Owner further has the right to list the property with other brokers. If a sale is made within months after this agreement terminates to parties found by the Real Estate Broker during the term of this agreement, and wherein the buyer has been disclosed to the Owner, the Owner shall pay the commission specified above.
 
4. If a deposit of money is forfeited by a purchaser produced by the Real Estate Broker, one half shall be retained by the Real Estate Broker, providing that this amount does not exceed the commission, and one half shall be paid to the Owner.

IN WITNESS WHEREOF both the parties have subscribed their respective hands on these presence on the place, date, month and year first above mentioned in the presence of the following witnesses :
