Under Section 138 of Negotiable Instruments Act,
1881
Under instructions
from our client ______________________ (Give name
and address). We hereby on our clients' behalf
state as under and serve upon you with the
following Notice under section 138 of Negotiable
Instruments Act, 1881:
1. That
______________ (Give the facts and circumstances
leading to the issuance of the cheques).
2. That in
discharge of your liability towards my client you
issued cheque (s) No. ____________ (Give
No. of the Cheque) drawn on _____________ (Give
name of the Bank) dated _________ (Give date) for
a sum of Rs. ___________ (Give the amount).
3. That on
__________ (Give date) my client presented the
above cheque (s) to _______________ (Give name of
the bank). However, the same was returned
unpaid by the bank on __________ (Give date) with
the advice __________ (Give remarks such as
insufficient funds, payment
stopped by drawer etc).
4. That my client
immediately got in touch with you, and informed
about the said dishonourment of the cheques and
requested you make the payment. However, my
client has not received any response from you. As
such my client is left with no other option but
to send you this notice.
In these
circumstances, I call upon you to pay to my
client the amount of Rs. ____________ (Give the
amount) within 15 days of the receipt of this
notice.
Please note,
failure on your part in discharging the above
mentioned legal liabilities will render you
liable for civil and criminal action.
Further, my clients also reserve their option of
initiating appropriate criminal proceeding under
sections 415, 417, 418 & 420 of the Indian
Penal Code 1860, which incorporates rigorous
punitive/penal action. Kindly also take notice
that on your failure to make the above payment
within the said period my client will be entitled
to interest at the rate of ____% per annum till
the payment is received or recovered as the case
may be.
